September 16th, 2008 As many of you may have been aware of, Wells Fargo and ORIX were supposed to begin their trial against Predatorix in Dallas today. However, due to Hurricane Ike and the President's declaration of the "natural disaster of catastrophic proportions", and the fact that about half the people (including witnesses and experts, as well as myself) are located in Houston without electricity, A/C, water, gas, etc. Therefore, the Honorable Judge Boyle has decided to postpone the trial to January 2009. I would like to thank those who were planning on attending and I am sorry this happened but it was totally out of my hands (trust me, if I could have stop the hurricane I would have). |

August 12th, 2008 BTW, I would like to throw out my next prediction: due to the plethora of illegal by the financial institutions, starting in 2009 or 2010, the USA will slide into a depression. These banks have stolen thousands of homes and caused over a trillion dollars of damage to the housing market (homes nationwide have lost as much as 50% of their value) as well as the financial world (pension funds, retirement funds, etc. have lost hundreds of billions of dollars). Not to mention numerous banks have already failed in the past several weeks... Also, I have updated the Recommendations section as well as added a new section called Related Sites. July 29th, 2008 If you read it all (with or without exhibits) youll see its such a powerful paper which easily summarizes all of the problems which have plagued the market/economy for the past year, the same problems Predatorix forewarned and tried to help prevent by educating the public, as stated in her article. Given everything thats happened over the past year, I believe my website and I still helped save another $1-2 trillion worth of damages to the world capital and housing markets. How? As this is a ponzi pyramid scam, had this racket perpetuated just one more year, the damages would have been more than all the years before it. I feel sorry for the chumps that took the bait. Now is an even BETTER time to short as over the next few years, for $18B worth of asset to convert to a $18B liability means (example) $6B of losses every year for the next 6 years (net change of $36 billion) -- now that bites.If you made the 15% shorting Wells Fargo or ORIX, good job, heres another chance to make even more. June 30th, 2008 Had you shorted WFC or IX even longer before (roughly a year ago when I mentioned it in one of my Magic Tricks papers, cant recall which one off the top of my head), you could have easily made 50% (WFC fell from over $36 to below $24 and IX fell from around $130 to nearly $60 within the past year) or considerably more had you purchased ATM puts. FWIW, my opinion is that they'll continue falling. The funny thing is, I havent even posted the document I mentioned last Tuesday.. It will be interesting to see the impact on the market once the right people read it and understand it. I think I will post it sometime this week. |

Its a brief filed in my hometown (Houston) against Wells Fargo and ORIX which incredibly easily flat out proves huge tax fraud by the MLMI trust which Wells Fargo is the trustee of. Big news is about to happen if the right people understand whats going on. May 6th, 2008 Nonetheless, I present to you this week's Pick-of-the-Week. It is yet another AMAZING ruling by the Honorable Joel Rosenthal (federal bankruptcy judge) against Wells Fargo. Ruling-by-ruling, it is becoming more and more apparent that judges are no longer tolerating the "heavy handed tactics" and BS that wreckless REMIC trustees and ruthless servicers (like Wells Fargo and ORIX) have pulled in courts over the past years. Not only did this judge rule against Wells Fargo $250,000, but he also sanctioned its servicer $250,000, and the law firms and attorneys that represented them another $100,000! At this rate, with all the new judgments against Wells Fargo, I may just start up a new section called "Justice Hall of Fame" or something , as I believe they need to be recognized for their fair and just rulings. |

April 9th, 2008 One regarding the executive branch (Bush) and legislative branch (House) "Jockeying Over Foreclosure Fix". It includes a very good quote from Barney Frank where he gives a warning to servicers. Who would have thought that the best fix would be by the judicial branch; courts kicking out servicers for not having valid claims and or true standing against borrowers? "Why Foreclosure Numbers Matter" and "What Are Those Mortgage Servicers Doing?" are two articles written in Q2 '07, basically posing the question, "Why are Servicers so eager to engineer defaults and force borrowers into foreclosure?". The answer to that question was the SFE vs. Wells Fargo and ORIX lawsuit filed in Q1 '06 (see POTW 3-25-08 for more on the lawsuit). The fourth article, "First Line of Foreclosure Defense - Are You Really The Plaintiff?" is letting borrowers know one of the best defenses against a Servicer, YOU DONT HAVE STANDING (take note of the Southern District and Northern District of Ohio who both dismissed Servicers' bogus claims)! |
April 8th, 2008 Lets see, Baltimore hates Wells Fargo, Cleveland hates Wells Fargo, and Illinois hates Wells Fargo. The FBI is investigating Wells Fargo and the IRS is investigating REMICs (Wells Fargo is trustee of ~90% of CMBS trusts) for tax fraud -- and these are just the few entities that come to mind that are after Wells Fargo for predatory lending, tax fraud, and other illegal acts. |

March 18th, 2008 Funny, I get the USA Today and Wall Street Journal both in print. Everyday I wake up, check the papers, and immediately feel both pleased and disappointed at the same time -- pleased because I was right over a year ago when I called the multi-billion dollar losses, and disappointed because .. I was right about the multi-billion dollar losses, heh.. I just realized I forgot to mention that the website is also dedicated to American taxpayers because they are the ones "left holding the bill" as the government hands out billions to bailout the banks for their illegal acts. So let me revise what I said last time -- woe art investors, woe art borrowers, and woe art taxpayers! I would just like to reiterate a few pending predictions; 1) MBS losses will exceed $1 trillion, 2) widespread CMBS failures will follow the current RMBS failures (hello!), and 3) Wells Fargo will decrease MSRs this year 4) Wells Fargo will reject every stockholder proposal this year.. So far, every prediction I have made has been correctOn a much lighter note, check out this hilarious video from the Comedy Central website on Bush's attempt to comfort investors and Jim Cramer's advice to hold Bear Sterns days before it went from $60/share to $2/share. |

As there is a plethora of content on Predatorix, I am sure the website will now be a much more effective tool in helping people educate themselves on certain topics (ie. REMIC, MSRs, Kovacevich, etc) but dont know where to begin. Also, for example, if you remember a phrase I used but cannot remember which page it was from (happens to me all the time), just type in the phrase with quotations, such as "prohibited income", "appraisal reduction", or "the secret partnership", and it will find it! When I woke up this morning, the first thing that poped into my head was the New York Times article I read a while back that announced that the IRS is investigating REMIC trusts. I came straight to my computer (pajamas and all) and began putting it up. Im not sure why I held for so long, but anyways, its great news (unless your Richard Kovacevich, Yoshihiko Miyauchi, or any of the others who were behind the illegal acts). After nearly 2 YEARS of ranting and raving about Wells Fargo and ORIX's tax fraud and plethora of other illegal acts, composing hundreds of papers, powerpoints, videos, and POTWs, something is finally being done.. I guess my 7-3-07 and 8-7-07 "Notice to the IRS" POTWs really hit home I gotta go take a final exam, but im writing another paper which ill put up later tomorrow night or so. |

October 11th, 2007 This false affidavit ultimately led to a fraudulent judgment for DOUBLE the original loan amount against the borrower, AND Wells Fargo and ORIX stealing the apartment complex, AND Wells Fargo and ORIX suing the depositor for the original loan amount. The same thing happened to the borrower behind the Lee Hall Loan. Thanks to the information on Predatorix, the Virginia State Supreme Court slammed Wells Fargo and ORIX on the multiple recovery issue. The borrower is still fighting today, over 5 years later, to undo the damage caused by all of Wells Fargo and ORIX's lies and false affidavits, including this one. This video is dedicated to them. |

September 15th, 2007 On a side note, I was looking through the "Just Pay" article from the Economist and saw ORIX's CEO, James Thompson (you know, Captain J), proudly declared "We have an obligation to certificateholders" (true). In the 9-11-07 POTW you will find Henry Bomar saying the same "fiduciary responsibility to noteholders" (also true), and a Wells Fargo and ORIX motion to a Dallas Court, flat out claiming "No Fiduciary Duty" (LIE!). By the way, plenty of other Wells Fargo and ORIX execs testified "no fiduciary duty" in recent cases. Funny, not too long ago they were saying the complete opposite. I dont think it gets any more clear that Wells Fargo and ORIX executives (and their lawyers) are compulsive liars. |

July 24th, 2007 This report shows a systematic extortion racket whereby Wells Fargo and its servicers, in this case one of ORIX's divisions (ORIX Financial Services), use loan documents to engineer and fabricate technical defaults to obtain fraudulent judgments far in excess of the original loan obligation, thus, bankrupting borrowers and stripping them (and their families) of equity. I also have their "Litigation Pipeline" which I may post later. I would analogize the two pipeline reports to the diary of a murderer. This could be a field day for the USDOJ! |

The seminars were very informative and had highly knowledgeable panels. The second article is a transcript of Ben Bernanke's last speech titled, "Regulation and Financial Innovation" with a few notations on things to consider which I have included myself. I have updated the First Union Plaza (999 Peachtree) case in the Borrower's Cases section of the site. The appeal court rejected Wells Fargo and ORIX's extortion/harassment attempt and made several other breakthroughs. Good job! |

It was a humiliating defeat for Wells Fargo and ORIX, both of whom were both found to have committed Champerty (a disastrous branding for any financial institution), or Barratry, on behalf of the MLMI 1999-C1 Trust whose name was also besmirched. |

February 25th, 2007 Sorry everyone, my site hit the front page of digg.com and for the first time the site exceeded 600,000 hits in a day which caused the site to go down for about an hour. Thankfully the host upgraded my site to the top hosting package so we are back up! Digg away! And yes, I am 18. Cliffs: I discovered gross securities violations by Wells Fargo, mostly relating to fraudulent accounting, predatory lending, and flat out illegal mortgage backed securities practices. To see the original complaint filed in the Federal Court of Dallas, read this. Wells Fargo booked over $17,000,000,000 in Mortgage Servicing Rights (basically, they book the right to screw people with fees as an asset) and issued shares to management. Little by little, they are diluting the power of shareholders (as they have rejected every shareholder proposal since 2002) and taking over more and more of the company by booking increased MSRs yearly. Presently, MSRs are equal to 39% of shareholders equity! I would like to note that Wells Fargo was not always a bad company. It was taken over in 1998 by Richard Kovacevich who was the President, Chairman, and CEO of Norwest, who then integrated his crooked schematics into Wells Fargo (which is why the logo for Predatorix is a Wolf in Sheep's clothing). **UPDATE** See the August 3rd, 2007 post, Richard Kovacevich Exited Wells Fargo without getting caught.
